Terms for hosting, domains, managed services and custom development contracts. Updated: 14 October 2026.
These terms apply to contracts between Lukas Dahle, trading as Systey, and consumers (section 13 German Civil Code, BGB) or businesses (section 14 BGB) for hosting, domains, managed services and custom development where incorporated at contract formation. Individual agreements take priority.
Conflicting business terms apply only if we agree to their incorporation. Individual agreements remain effective without any specific form.
The customer's contracting party is Systey, owner Lukas Dahle, Marienfelder Straße 46, 33649 Bielefeld, Germany, email contact@systey.com. You can find the complete provider information in the imprint.
The specific scope of services results from the respective product or tariff description, the individual offer or the order. In particular, we provide:
Resources, features, locations and conditions described before ordering define the service. Customers administer, update and secure their own systems unless a managed service is expressly included. For development work, scope, deadlines, usage rights and any acceptance procedure are specified in the individual offer; statutory rules otherwise apply.
A customer account is required to use the dashboard and to order services. The customer is obliged to provide truthful and complete information during registration and to confirm their email address. Access is only enabled after verification has been completed.
The access credentials are to be treated confidentially and protected against access by third parties. The customer will inform us immediately if there are indications of misuse of their account.
Product listings invite orders. You can review and correct your details before submitting a binding paid order. We accept through an express contract confirmation or by providing the ordered service. A mere acknowledgement of receipt is not acceptance. Individual offers specify how they may be accepted.
The total prices shown before ordering apply, including any setup charges and applicable taxes. Recurring charges and billing periods are shown separately. Where the small business exemption under section 19 German VAT Act applies, no VAT is charged.
Payment methods offered at checkout apply; these include Mollie and existing account credit. Advance payment is required only where agreed before ordering. Credit transactions are visible in your account. Statutory refund rights remain unaffected; paid, unused credit does not expire merely because an account is closed.
In the event of payment default, we may proportionately suspend the affected service after an unsuccessful reasonable payment deadline and advance warning, subject to statutory requirements. Valid objections, retention rights and statutory termination rights remain unaffected.
Service commencement and provisioning follow the order or offer and its agreed payment conditions. Customers provide the necessary information. For consumers, early commencement during the withdrawal period and any payment for services already supplied require the statutory conditions; accepting these terms does not replace any required express declaration.
Duration, minimum term, billing and renewal mode are shown before ordering. Prepaid services without automatic renewal end when the booked period expires unless actively renewed. For consumers, an initial binding term is at most two years and notice to end it at most one month. An agreed automatic renewal for consumers continues only for an indefinite period, terminable at any time on no more than one month’s notice. More favourable agreed cancellation conditions continue to apply.
You may cancel in text form, including by email to contact@systey.com. Statutory rights to electronic cancellation remain unaffected. Either party may terminate for cause where statutory requirements are met. Back up or transfer your data before the contract ends; storage afterwards is included only if separately agreed. Statutory data retrieval and transfer rights remain unaffected.
The customer is responsible for the content they store and transmit. In particular, they undertake:
Where there are concrete indications of unlawful use, we may restrict affected content or services to the necessary and proportionate extent. We explain the reasons and scope and allow remediation where legally permitted and possible without endangering systems. Statutory procedures and rights remain unaffected.
Binding availability and support commitments follow the service description or a separate agreement. We plan maintenance to minimise disruption and announce foreseeable significant interruptions. Maintenance and the use of upstream providers do not generally exclude our statutory service obligations or your rights during outages.
Our liability follows statutory law, including for defects, outages and data loss. These terms do not limit statutory warranty or damages claims.
Consumer rights for digital products, including conformity, required updates, price reduction and termination, remain unaffected. A customer backup obligation does not remove any agreed Systey backup obligations.
Consumers have a statutory right of withdrawal for distance contracts. The details result from the separate withdrawal instructions. Simply activating an ongoing hosting contract does not extinguish this right. Early expiry and any payment for services already supplied depend on statutory requirements and the withdrawal notice.
Information on the processing of personal data can be found in our privacy policy. Where we process personal data on your behalf, an agreement under Article 28 GDPR is required before processing begins. These terms do not replace that agreement.
The version incorporated at contract formation applies to each order. Changes to existing contracts require agreement or a statutory basis. Silence is not consent. Publishing new terms does not automatically change existing contracts.
Registration and transfer take place through registration service providers and the relevant registry. An availability search does not reserve a domain; registration depends on registry acceptance. Any additional registration conditions are made available before ordering. Customers provide accurate registrant data and respect third-party rights. Renewal, transfer and termination follow the conditions communicated before ordering and mandatory law. Ending your Systey contract does not replace arranging a timely transfer if you wish to keep the domain.
The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected. Insofar as the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is our registered office.
Statutory provisions apply to ineffective clauses (section 306 BGB).
